Notice of Public Comment Period and Public Hearing for Proposed Regulation and Ordinance Revisions

Notice is hereby given that the Chattanooga-Hamilton County Air Pollution Control Board will receive public comments upon proposed revisions to the following regulations:

  • The Hamilton County Air Pollution Control Regulation,
  • The Chattanooga Air Pollution Control Ordinance,
  • The Collegedale Air Pollution Control Ordinance,
  • The East Ridge Air Pollution Control Ordinance,
  • The Lakesite Air Pollution Control Ordinance,
  • The Lookout Mountain Air Pollution Control Ordinance,
  • The Red Bank Air Pollution Control Ordinance,
  • The Ridgeside Air Pollution Control Ordinance,
  • The Signal Mountain Air Pollution Control Ordinance,
  • The Soddy-Daisy Air Pollution Control Ordinance, and
  • The Walden Air Pollution Control Ordinance.
    The proposed revisions will be incorporated into the Tennessee State
    Implementation Plan for the attainment and maintenance of air quality. The matters that
    are the being considered by the revisions consist of the following:
  • Removal of “affirmative defense” provisions that apply to excess emissions from
    Part 70 sources during periods of startup, shutdown, and malfunction, as directed by
    the U.S. EPA;
  • Removal of general “affirmative defense” provisions that apply to excess emissions
    during periods of startup, shutdown, and malfunction, as recommended by the U.S.
    EPA;
  • Revision of a national ambient air quality standard;
  • Incorporation by reference of the most current of various federal regulations;
  • Removal of an unnecessary provision for alternatively permitting equipment as a
    locally defined “minor pollution source”;
  • Addition of a requirement for the Director to report confidentiality request
    determinations to the Board;
  • Update name of a national emission standard;
  • Correction of two date errors; and
  • Correction of an ordinance reference.

A public hearing concerning the proposed revisions will be held at 9:00 a.m. EDT,
Thursday, August 22, 2024, at the Bureau office located at the above address. Any person
desiring to present comments at the hearing should be prepared to offer a written
statement to be incorporated into the hearing record. Written comments not presented
at the hearing will also be considered part of the record if they are mailed or delivered to
the Bureau Executive Director at the above address and are received by the time of the
hearing.
Furthermore, the federal regulations that are to be incorporated by reference will be
available for public review, pursuant to Tennessee Code Annotated Sections 68-201-
115 and 10-7-121, at the Hamilton County Clerk’s office, 625 Georgia Avenue, Room
201, Chattanooga, TN, between 8:00 a.m. and 4:30 p.m. EDT, Monday through Friday,
beginning on Wednesday, July 3, 2024.
